Texas groundwater law has become increasingly complex: common law landowner property rights, local groundwater district regulation and state administered groundwater management areas. Recent Texas Supreme Court Case and a Fourth Court of Appeal rulings raise important issues about the scope of the landowner's private property rights in groundwater.
